Terms of Service
Every project starts with a written proposal and invoice. You pay a 40% advance to begin and the remaining 60% before final handover. After full payment, the custom deliverables built for you belong to you, and you get 30 days of bug-fix support. Full details are in our Project Terms & Conditions (Section 05).
01 About These Terms
These Terms of Service govern your use of www.bielco.in (the “Website”), operated by Bielco (“we”, “us”, “our”), a web design and development business based at Sector 16, Rohini, Delhi, India. By using the Website, you agree to these Terms. If you hire us for a project, our Project Terms & Conditions (Section 05) also apply.
02 Using Our Website
When using the Website, you agree not to:
- Submit false information, or another person’s personal data without their permission.
- Send spam, automated or bulk submissions through our forms or WhatsApp links.
- Attempt to hack, overload, scrape or interfere with the Website or its security.
- Use the Website for any unlawful, fraudulent or harmful purpose.
We may block access or ignore submissions that break these rules.
03 Website Content & Ownership
The text, designs, graphics, logo, case studies and code of this Website belong to Bielco or are used with permission. You may view the Website and share links to it, but you may not copy, republish or commercially use our content or branding without our written permission.
04 Enquiries, Proposals & Invoices
Submitting the contact form, messaging us on WhatsApp or booking a call is an enquiry only and does not create a contract. Prices, packages and timelines shown on the Website are indicative. A project begins only when:
- We send you a written proposal / quotation and an invoice;
- You accept the proposal; and
- We receive the agreed advance payment.
The accepted proposal, the invoice and our Project Terms & Conditions together form the agreement for your project.
05 Project Terms & Conditions
Bielco Project Terms & Conditions
The full terms that apply to every client project: scope, payments, delays, revisions, handover, domain and hosting, bug fixes, intellectual property, confidentiality, cancellation and dispute resolution.
Highlights of the Project Terms:
- Scope: We deliver only what is listed in the approved quotation. Anything extra may be quoted as additional work, and scope changes must be agreed in writing.
- Client responsibilities: You provide the content, images, credentials, approvals and feedback we need, and confirm you have the right to use them.
- Delays: If you don’t respond for 7 consecutive days, we may place the project on hold. If there is still no response 14 days after that notice, the project may be marked as client-delayed or abandoned. Timelines extend by the length of any client-caused delay.
- Revisions: Minor in-scope changes are accommodated. Major changes, redesigns or new features may be quoted separately.
- Handover: Final files, source code and credentials are handed over after full payment. After that, you manage hosting, security, backups and updates unless you have a maintenance agreement with us.
- Domain & hosting: A domain registered in your name belongs to you. Hosting, domains, plugins, APIs and other third-party services are not included unless quoted, and their charges are payable by you.
If anything on this page conflicts with the Project Terms & Conditions or your accepted proposal, the accepted proposal and the Project Terms & Conditions prevail.
06 Ownership of Your Deliverables
- Your custom deliverables: Once we receive full payment, ownership of the custom source code, designs and assets created specifically for you is transferred to you.
- Bielco’s own materials: Bielco keeps ownership of its pre-existing materials, internal tools, reusable components, development methods, frameworks, templates, processes and general know-how.
- No lock-in: You are free to host your website with any provider and to hire any developer to modify or extend it, with no ongoing licence fees payable to Bielco.
- Third-party materials: Open-source libraries, fonts, plugins, images and APIs remain subject to their own licences (for example, MIT or Apache 2.0).
- Portfolio display: We may show the completed visual design and a case-study summary in our portfolio, unless a Non-Disclosure Agreement (NDA) is signed before the project starts.
07 Payments, Cancellation & Refunds
- Payment schedule: 40% advance to start the project. The remaining 60% is due on substantial completion and before final handover, unless your quotation states a different schedule.
- Release of deliverables: Final deliverables are released only after all outstanding payments are received.
- Cancellation: Either party may ask to end a project. If you cancel after work has started, we may keep amounts reasonably linked to work completed, resources committed and non-recoverable costs. Any amount due for work already performed remains payable.
- Refunds: The advance is not automatically refundable just because a client stops responding. If the amount you have paid is more than the value of work done and non-recoverable costs, any refund is decided under Clauses 5 and 18 of the Project Terms & Conditions.
08 30-Day Bug-Fix Support
For 30 days from final delivery (unless your quotation says otherwise), we fix genuine technical defects in the delivered work that are caused by our implementation and fall within the agreed scope. This does not cover new features, design changes after approval, changes made by you or other developers, problems caused by hosting, domain or third-party services, compromised credentials, or browser and platform updates.
09 Third-Party Links & Services
The Website links to third-party services such as WhatsApp, Instagram, LinkedIn and Facebook. We are not responsible for their content, availability or privacy practices. Their own terms and privacy policies apply when you use them.
10 Confidentiality
We keep confidential any non-public business, technical or financial information you share with us during an enquiry or project, including credentials and customer information. We disclose it only where the law requires or where it is reasonably necessary to deliver the agreed services. This obligation continues after the project ends.
11 Indemnity
You agree to compensate Bielco for losses, claims and reasonable costs arising from (a) your misuse of the Website or breach of these Terms, or (b) content, trademarks, images or other materials you supply that you do not have the right to use.
12 Limitation of Liability
To the maximum extent permitted by applicable law, Bielco shall not be liable for any indirect, incidental, punitive, or consequential damages (including loss of profits, data corruption, or third-party hosting outages). Our total cumulative liability arising from any engagement shall be limited to the total fees actually paid by the Client for the specific phase of work.
13 Force Majeure
Neither party is responsible for delays caused by events beyond reasonable control, such as natural disasters, government actions, or widespread internet or infrastructure failures. The affected party will inform the other within a reasonable time where practical.
14 Changes & Severability
We may update these Terms from time to time. We will change the “Last Updated” date and highlight important changes on the Website. Changes do not apply retroactively to projects already agreed: those continue under the terms you accepted. If any part of these Terms is found unenforceable, the rest remains in effect.
15 Governing Law & Disputes
- Governing law: These Terms are governed by the laws of India.
- Talk to us first: Please contact us at mail@bielco.in. Both parties will try in good faith to resolve the issue within 30 days.
- Arbitration: If a dispute about use of the Website is not resolved, it will be referred to a sole arbitrator appointed by mutual agreement under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Delhi, and proceedings will be in English. Courts in Delhi have jurisdiction for interim relief and enforcement.
- Client projects: Disputes about a client project are resolved under the dispute-resolution and governing-law clauses of the Project Terms & Conditions.
- Your legal rights: Nothing in these Terms limits rights you have under the Consumer Protection Act, 2019 or any other law that cannot be waived.
